What Does A Real Estate Attorney Do?

The short answer is that a real estate lawyer is someone who is licensed to practice real estate law and whose job it is to know the rules and regulations involving real estate transactions and other real estate related matters. The more accurate answer is that because the field of real estate law is vast—encompassing many specialized areas—real estate lawyers often wear many hats. Essentially, there are eight common areas encompassing real estate law:

Sales & Leasing Transactions (Commercial & Residential). Behind every sale or lease is a contract. Generally residential purchase contracts are straight forward (boilerplate agreements) drafted so that real estate agents can help effectuate the transaction. However, leases and commercial purchase agreements can be wildly divergent and very complex. The best practice is to avoid free, web-based agreements and have a skilled and experienced attorney do the drafting to meet your specific needs.

Litigation & Dispute Resolution. Because of the many different types of contracts utilized within the broad scope of real estate law, there will always be disputes. Most disputes can be resolved through negotiation; however, some will invariably wind up in court. There is absolutely no substitute for an experienced trial lawyer to defend your interests.

Zoning & Land Use. Whether you’re looking for a zoning permit, a zoning variance, or a rezoning classification, you’ll want an experienced attorney on your side. Depending upon the type of action and the specific jurisdiction, zoning and land use issues can, at times, be very complex.

Real Estate Closings. While the Commonwealth of Kentucky does not mandate that real estate Closings be conducted by a licensed attorney, several states do. Just the same, many attorneys here in the Bluegrass do nothing else but real estate closings. This specified field may also include title searches and effectuating title insurance policies.

Agency Law. As representatives, real estate agents and brokers have a special relationship with their respective buyers and sellers. This special relationship is governed by the law of agency. Attorneys, here in Kentucky, may represent the interests of buyers and sellers who have a particular grievance with their representation, or they may represent brokers and agents who have been accused of violating their duty as an agent.  

Banking & Financing (Structured Workouts). This is a particularly varied area of real estate law. Attorneys can find themselves involved in staving off foreclosures, bringing or defending a breach of banking law, or helping to procure JV financing.

Property Management. Some attorneys (such as Richard David Lom) actually offer third-party property management services. Other attorneys may assist in mitigating property liability issues, tenant evictions, or the drafting of vendor contracts. Property management companies simply cannot provide adequate management services without the assistance of a skilled real estate attorney. 

Construction & Development. Building an apartment complex, subdivision or retail center (just to name a few) involves a host of legal issues including, but limited to, claims & disputes, construction defects, construction management, litigation & arbitration and construction advisory services. 

Of course, this list is far from exhaustive. Real estate attorneys can be found dealing with insurance matters, REIT investments, entity formation, licensing, real estate taxes and trust & estate issues—just to name a few.

What Do Real Estate Attorneys Charge?

How much you’ll spend paying your real estate attorney (or attorneys) will depend on what services you require. Some engagements are more complex, or require more specialization. Litigation, notwithstanding, real estate attorneys generally charge a fixed hourly rate. Rates here in the Lexington / Bluegrass area can range from $150 – $350 per hour, depending on the attorney’s experience and the nature of the work sought. In some cases, you might also be quoted a flat-fee for certain real estate matters that can be concluded rather quickly.
